Terms of Service
These Terms of Service ("Terms") govern your access to and use of MyAds and related services (collectively, the "Service") provided by MyAds ("we," "us," or "our"). By using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
1. The Service
MyAds is a cloud-based platform that helps teams create, organize, publish, and monitor digital advertising across supported third-party advertising networks and related channels. Features may include campaign management, creative tools, audience and budget configuration, lead capture forms, reporting, and optional AI-assisted generation. We may modify, add, or discontinue features with reasonable notice where appropriate.
2. Accounts and eligibility
You must provide accurate registration information and keep credentials secure. You are responsible for all activity under your account. You must be at least the age of majority in your jurisdiction (and not prohibited from receiving the Service under applicable law). We may refuse service or close accounts that violate these Terms or present security or legal risk.
3. Connected advertising accounts
Where you connect third-party advertising or measurement accounts, you authorize us to access and use those accounts as needed to provide the Service, consistent with permissions you grant. Your relationship with each platform (including Meta, Google, LinkedIn, TikTok, and others) remains subject to that platform's terms, policies, advertising standards, and API rules. You represent that you have all rights and consents necessary to connect those accounts and to publish the campaigns you configure.
4. Your content and data
You retain ownership of your campaign materials, creative assets, and business data. You grant us a worldwide, non-exclusive license to host, reproduce, process, transmit, display, and adapt your content solely to provide, secure, and improve the Service (including AI features you enable) and as described in our Privacy Policy. You represent and warrant that your content does not infringe third-party rights, violate law, or breach platform policies. You are solely responsible for the legality, accuracy, and appropriateness of your ads in each jurisdiction where they run.
5. AI-generated output
Optional AI tools may produce suggestions or draft assets. Outputs may be inaccurate or unsuitable for your brand or regulatory context. You must review and approve materials before publication. We do not warrant that AI output is error-free, non-infringing, or compliant with advertising or industry rules. You remain responsible for all creative and targeting decisions you implement.
6. Subscriptions, fees, and taxes
Paid plans and usage limits may apply as shown at purchase or in your workspace. Fees are billed through our third-party payment providers unless otherwise agreed. Taxes may be added where required. Failure to pay may result in suspension of paid features. Unless mandated otherwise, fees are non-refundable except as stated at checkout or required by law.
7. Acceptable use
You agree not to:
- Use the Service in violation of law, platform rules, or these Terms;
- Upload malware, attempt unauthorized access, or probe or stress our systems without permission;
- Misrepresent identity, impersonate others, or engage in deceptive advertising practices;
- Transmit content that is defamatory, harassing, hateful, or exploits minors;
- Scrape, harvest, or excessively automate the Service except via documented APIs or written approval;
- Use the Service to build a competing product based on unauthorized extraction of our data or UI.
8. Intellectual property
We and our licensors own the Service, including software, branding, documentation, and aggregated statistical insights derived from our systems (excluding your confidential business data). Feedback you provide may be used without obligation to you.
9. Third-party services
The Service relies on third-party platforms, data providers, and infrastructure. We are not responsible for third-party outages, policy changes, disapprovals of ads, spend delivery, auction outcomes, or metrics accuracy on external systems.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT GUARANTEE UNINTERRUPTED OPERATION, ERROR FREE OUTPUT, OR SPECIFIC ADVERTISING RESULTS.
11. Limitation of liability
To the fullest extent permitted by law, neither MyAds nor its suppliers will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, goodwill, or data, arising from your use of the Service, even if advised of the possibility. Our aggregate liability for claims arising out of or related to the Service will not exceed the greater of (a) the amounts you paid to us for the Service in the twelve (12) months before the claim or (b) one hundred U.S. dollars (US $100), except where liability cannot be limited by law.
12. Indemnity
You will defend and indemnify MyAds and its affiliates, officers, and employees against third-party claims, damages, and costs (including reasonable attorneys' fees) arising from your content, your campaigns, your breach of these Terms, or your violation of law or third-party rights.
13. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access for breach, risk to the Service or others, legal or platform-driven requirements, or non-payment. Provisions that by their nature should survive will survive termination, including ownership, disclaimers, limitations of liability, and indemnity.
14. Changes
We may update these Terms by posting a revised version and updating the "Last updated" date. If a change is material, we will provide additional notice where appropriate. Continued use after the effective date constitutes acceptance of the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, except where mandatory local law provides otherwise. Courts located in Delaware, USA, have exclusive jurisdiction over disputes, subject to applicable consumer protections that cannot be waived.
